We would like to inform you about several recent procedural developments in the criminal proceedings currently pending before the United States District Court for the District of New Jersey.

During June 2026, one of the defendants filed motions seeking dismissal of the Indictment, arguing that certain procedural violations occurred during the course of the proceedings, including alleged issues relating to the defendant’s right to a timely trial.

Following the filing of these motions, the Government submitted a letter requesting a status conference with the Court in order to determine whether the trial currently scheduled for October 6, 2026, remains on track.

According to the Government’s filing, prosecutors disagree with the arguments raised by the defense and maintain that the motions lack merit. At the same time, the Government indicated that even if the Court were to find that a procedural violation had occurred, such a ruling would not necessarily bring the case to a permanent end.

The Government explained that, under its view of the applicable law, any dismissal based on the arguments currently raised by the defense would likely be without prejudice. In practical terms, this would mean that the Government could seek a new indictment and continue the prosecution rather than permanently terminating the case.

As a result, one of the key issues currently before the Court is not whether the proceedings will necessarily end, but rather how any potential procedural ruling could affect the future course of the case and the timing of the scheduled trial.

The Government also emphasized that it remains committed to proceeding with trial on October 6, 2026, and requested clarification from the Court regarding whether that trial date remains in place before determining how it will formally respond to the defense motions.

In addition, recent docket entries reflect developments concerning sentencing proceedings for one of the individuals who previously entered a guilty plea in the case. The Court determined that certain sentencing submissions were not filed within the required deadline and, as a result, adjourned the sentencing hearing. A new sentencing date is expected to be scheduled at a later time.

At this stage, the Court has not ruled on the defense motions, and no determination has been made regarding the issues raised therein. The current developments concern procedural matters that may affect the future schedule and progression of the proceedings.
