In our previous update, we explained what may happen after a case such as Grand Pacific Trade is returned for further investigation and why additional investigative work does not, by itself, determine the eventual outcome.

At present, we have not received new official information confirming that the additional investigation has been completed or that a new decision has been made in the case.

This week, we would therefore like to address a related question: if particular investigative steps have been completed, does that mean that a new decision should immediately follow?

Not necessarily.

Completing an investigative step is not the same as completing the case

An additional investigation may consist of several separate steps.

Information may need to be obtained from financial institutions, particular transactions may require verification, individuals may need to be identified or questioned, or information may be requested from authorities in another jurisdiction.

These steps do not necessarily take place at the same time.

The completion of one particular investigative action therefore does not mean that all additional investigative work has been completed.

This distinction is especially important in cases involving international financial transactions, where information obtained from one source may create a need for further verification elsewhere.

New evidence may create new questions

Additional investigation is not always a linear process in which the authorities simply complete a predetermined list of tasks and then issue a decision.

A newly obtained bank record, transaction, company document or information concerning a particular individual may reveal a connection that was not previously known.

That information may then need to be compared with existing evidence or verified through another institution or jurisdiction.

For this reason, additional investigative work can sometimes expand as new information becomes available.

What happens before a new decision is made?

Once the competent authority considers that the necessary investigative work has been completed, the newly obtained material must be assessed together with the evidence already contained in the case file.

The important question is therefore not only whether additional evidence has been collected, but what that evidence establishes when considered as part of the case as a whole.

Only after that assessment can a further procedural decision be expected.

This is also why the passage of time alone does not tell us whether the additional investigation has produced evidence that strengthens, weakens or otherwise changes the case.

Why does this distinction matter for Grand Pacific Trade victims?

For victims, it can sometimes appear that once an additional document, transaction or person has been examined, the next step should immediately be a formal decision.

In practice, there may be a period between the collection of relevant information and a procedural development that can officially be communicated.

We therefore consider it important not to speculate about the result of the additional investigation before verified information becomes available.

At the same time, the fact that the case was returned for further investigation remains relevant: issues identified in the earlier stage required additional examination before a new assessment of the case could be made.

What is the current position?

At present, there is no additional action required from our clients.

You do not need to resend documentation that has already been provided.

We will continue to monitor whether there is confirmation that the additional investigation has been completed and, more importantly, whether a new procedural decision has been made on the basis of the supplemented case file.

Once we receive verified information concerning such a development, we will assess what it means for the Grand Pacific Trade case and for your position as victims and inform you accordingly.
