Dear Clients,

In early October, new procedural developments were recorded in the BitClub Network case concerning one of the defendants, Jobadiah Sinclair Weeks.

Although these developments do not directly concern the recovery of funds by affected investors, we believe it is important to keep you informed about their significance and their potential implications for the proceedings.

New Motion to Modify Conditions of Release

On October 5, 2026, Jobadiah Sinclair Weeks, through his defense attorney, filed a motion requesting modifications to the conditions of his release while the criminal proceedings remain pending (Motion to Modify Conditions of Release).

Two days later, on October 7, the motion was referred to a magistrate judge for consideration.

Under U.S. criminal procedure, conditions of release may include various restrictions and obligations that a defendant must comply with while criminal proceedings are ongoing.

A defendant may request modifications to these conditions, but the final decision rests with the Court, which must consider the relevant circumstances.

Importantly, neither the filing of such a motion nor its referral to a judge means that the requested modifications have been approved.

Does this motion affect the defendant’s criminal responsibility?

Not directly.

Decisions concerning conditions of release primarily relate to a defendant’s procedural status during criminal proceedings. They do not, in themselves, constitute a determination of guilt or establish the final outcome of the criminal case.

We would also like to remind our clients that, in February 2026, the Court denied an earlier request by Weeks to modify his conditions of release.

The new motion filed in October represents a separate procedural step, which must be considered by the Court based on the circumstances and arguments presented.

What does this mean for BitClub Network victims?

We understand that the most important question for affected investors remains the possibility of recovering their lost funds.

However, it is important to distinguish between procedural requests concerning the personal circumstances of individual defendants and decisions that may directly affect property, compensation, and victims’ rights.

Weeks’ latest motion does not constitute a decision regarding the distribution of assets or compensation for investors.

Nevertheless, following these procedural developments allows us to maintain a more complete understanding of the case and identify any future decisions that may be relevant to our clients’ interests.

What can we expect next?

At the time of preparing this update, we have not identified a confirmed Court decision on Weeks’ latest motion.

We will continue to monitor this and other relevant procedural developments, particularly those concerning assets connected to the BitClub Network case and potential avenues for victims to pursue recovery of their funds.

Our priority remains protecting our clients’ interests and assessing all legally available options for recovering their financial losses.

Should any significant developments occur, we will inform you promptly, explain their implications, and outline any potential next steps.

Thank you for your continued trust.

Kind regards,
Attorney Zoran Miljaković
