Bitclub Newsletter No. 206
Dear Clients,
As previously reported, one of the significant developments in the BitClub Network case was the dismissal of criminal charges against Matthew Goettsche in July 2026.
Although we have already informed you about this decision, we believe it is worth revisiting one important question: What does the dismissal of charges against one defendant actually mean for the broader case and affected investors?
A reminder of what the Court decided
At the request of the U.S. Department of Justice, the Court dismissed the charges against Goettsche with prejudice, meaning that those charges cannot be brought against him again in the same case.
However, this decision did not follow a trial in which the Court examined the evidence and reached a verdict on his guilt.
It is therefore important to distinguish between the termination of criminal proceedings against an individual defendant and a judicial determination that the alleged fraudulent activities did not occur.
Why does this distinction matter?
The BitClub Network case has involved multiple defendants, some of whom previously pleaded guilty.
The dismissal of charges against Goettsche does not automatically determine the legal position of other individuals involved in the case, nor does it resolve all questions concerning the rights of affected investors.
For victims, the key issue remains whether legally available avenues exist to pursue recovery of their financial losses.
What is the current situation?
At present, we have no new verified Court decisions that would significantly change the previously reported status of the case.
Nevertheless, we consider it important to clarify the implications of earlier decisions so that our clients have an accurate understanding of the proceedings.
We will continue monitoring relevant developments and assessing any legal options that may become available to protect investors’ interests.
Thank you for your continued trust.
Kind regards,
Attorney Zoran Miljaković
