Allied Capital Trade Newsletter No. 135

Dear Clients,
One of the frequently asked questions in cases such as Allied Capital Trade concerns the role of banks in situations where funds were transferred through traditional banking channels or payment cards.
In practice, a significant number of payments to platforms later identified as fraudulent are made through the banking system. This includes both domestic and international wire transfers, as well as card payments processed through various payment providers.
In such cases, banks do not participate in the fraud itself, but they can represent an important source of information regarding the flow of funds. Transaction records, details about recipients, and data on related accounts may be relevant for further analysis and for the actions of competent authorities.
In certain situations, particularly when action is taken promptly, it may be possible to attempt a reversal of the transaction or initiate a refund procedure (such as a chargeback in the case of card payments). However, the success of these mechanisms depends on several factors, including the time elapsed since the transaction and the method by which the payment was made.
Once the funds have been further transferred, the role of banks is primarily reflected in providing information that can assist in reconstructing financial flows and identifying participants involved in the transfer chain.
Understanding the role of banks in these proceedings helps to place both the possibilities and limitations into a realistic context, as well as to emphasize the importance of timely action.
As always, we will inform you promptly of any relevant developments.
Kind regards,
