Dear Clients,

In cases related to ProCap, a common question that arises is whether the amount of individual loss has any impact on the course of the proceedings, and whether victims who invested larger sums are in a different position compared to others.

This concern is understandable, especially in situations where there are significant differences in the amounts that were invested.

However, it is important to emphasize that in criminal proceedings, the case is viewed as a whole, rather than through the individual amounts of each victim.

In other words, the fact that someone invested a higher or lower amount does not affect whether the proceedings will be conducted, nor does it change the way the facts are established.

On the other hand, the overall amount of damage may be relevant at certain stages of the proceedings, particularly when assessing the scale of the case, but it does not alter the position or rights of individual victims.

In practice, each victim is considered as part of a broader case, where the primary focus is on establishing how the fraud was carried out, as well as identifying the individuals responsible.

For that reason, it is important to understand that, regardless of the amount involved, each case has its significance and contributes to the overall understanding of the situation.

You will be informed in a timely manner about any further relevant developments.

Kind regards,
Attorney Zoran Miljaković
