We would like to inform you about the latest developments in the BitClub Network case.
The Prosecutor’s Office has submitted a written response to the Court regarding the defendant Jobadiah Sinclair Weeks’s motion to terminate the conditions of his release. In their response, the Prosecutor’s Office explains that the defendant’s claim—that the conditions should be terminated because the maximum penalty for the offense is five years and he has been on release for longer—is unfounded, as the maximum penalty applies only to the period of incarceration, while the defendant has been in custody for approximately 11 months. Furthermore, the Prosecutor’s Office emphasizes that the claim that he has not been provided with evidence of victims or losses is not a basis for terminating the release conditions, since those conditions are intended to ensure his appearance in court and the safety of the community, and do not depend on the extent of evidence provided. Additionally, although the defendant cites personal hardship due to the imminent birth of his child, the Prosecutor’s Office notes that there is no parental exception to release conditions, and many defendants with families continue to comply with release conditions without exception.
Other than this important response from the Prosecutor’s Office, there are no significant updates in the case. The proceedings remain in the stage of reviewing submitted documentation and preparing the next steps.
