Kako završavamo pripremu naše krivične prijave u vezi sa platformom COTP, želimo da Vam približimo šta sleduje nakon njenog podnošenja i kako proces funkcioniše.
Kada tužilaštvo primi prijavu, započinje istraga. To je faza u kojoj se prikupljaju svi relevantni dokazi: finansijski dokumenti, transakcije, komunikacije, izjave oštećenih i svedoka, kao i materijali iz inostranstva, ukoliko je potrebno. Istraga može trajati mesecima, ali je ključna za definisanje obima slučaja i pronalaženje svih relevantnih činjenica.
U slučaju COTP, istraga može obuhvatiti:
- proveru transakcija i finansijskih tokova unutar platforme,
- prikupljanje dokumenata i komunikacija između predstavnika platforme i korisnika,
- saslušanje oštećenih i svedoka,
- pribavljanje dokaza iz inostranstva, ako je potrebno.
Cilj istrage je da tužilaštvo sakupi dovoljno dokaza kako bi procenilo da li postoji osnov za podizanje optužnice. Kada se optužnica podigne, predmet izlazi iz faze istrage i prelazi u sudski postupak, gde se dokazi iznose pred sudom, saslušavaju stranke i donosi presuda.
Zbog toga je svaka priprema i sistematizacija dokumenata i dokaza izuzetno važna – dobro pripremljena prijava i materijali omogućavaju tužilaštvu da efikasno donese odluku i da postupak kasnije teče brže i preciznije.

As we finalize the preparation of our criminal complaint regarding the COTP platform, we would like to provide you with an overview of what follows after its submission and how the process works.
Once the Prosecutor’s Office receives the complaint, an investigation begins. This is the phase during which all relevant evidence is collected: financial documents, transactions, communications, statements from victims and witnesses, as well as materials from abroad, if necessary. The investigation can last for several months but is crucial for defining the scope of the case and identifying all relevant facts.
In the COTP case, the investigation may include:
- reviewing transactions and financial flows within the platform,
- collecting documents and communications between platform representatives and users,
- interviewing victims and witnesses,
- obtaining evidence from abroad, if necessary.
The purpose of the investigation is for the Prosecutor’s Office to gather enough evidence to determine whether there is a basis for filing an indictment. Once the indictment is filed, the case moves out of the investigation phase and enters the judicial process, where evidence is presented in court, parties are heard, and a verdict is rendered.
For this reason, thorough preparation and systematic organization of documents and evidence is extremely important – a well-prepared complaint and supporting materials allow the Prosecutor’s Office to make decisions efficiently and ensure that the process proceeds more quickly and accurately.
