Kod predmeta koji traju duže vreme jedno od najčešćih pitanja je šta znači kada određeni period nema novih informacija koje se mogu podeliti sa oštećenima.

Ovo pitanje je posebno razumljivo u predmetima poput Allied Capital Trade, gde je od prvobitnih ulaganja i gubitka sredstava proteklo značajno vreme.

Zbog toga ove nedelje želimo da objasnimo jednu važnu stvar: odsustvo novih javno dostupnih informacija ne mora istovremeno značiti da je predmet završen ili da više ne postoje mogućnosti za dalje postupanje.

Zašto u ovakvim predmetima mogu postojati dugi periodi bez vidljivih promena?

Međunarodni predmeti investicionih prevara razlikuju se od jednostavnijih slučajeva u kojima su učesnici, računi i tok novca poznati od samog početka.

Novac može prolaziti kroz više država, kompanija, bankovnih računa, pružalaca platnih usluga ili kripto-novčanika. Informacije potrebne za utvrđivanje tih tokova mogu se nalaziti kod različitih institucija i u različitim državama.

Zbog toga određeni koraci mogu trajati znatno duže nego što je to spolja vidljivo.

Nisu sve informacije odmah dostupne oštećenima

Važno je imati u vidu i da se sve informacije do kojih nadležni organi eventualno dođu tokom postupanja ne objavljuju automatski.

Određeni podaci mogu ostati poverljivi dok traje provera, istraga ili komunikacija između nadležnih organa.

Zbog toga može postojati razlika između onoga što se trenutno može saopštiti oštećenima i onoga što se eventualno preduzima ili proverava u okviru određenog postupka.

Protek vremena ipak jeste važan

Sa druge strane, bilo bi pogrešno tvrditi da vreme nema nikakav značaj.

Što više vremena prolazi, mogu se pojaviti dodatne praktične i pravne poteškoće. Dokumentacija može postati teže dostupna, kompanije mogu prestati da postoje, računi mogu biti zatvoreni, a sredstva dalje preneta.

U zavisnosti od države i vrste postupka, mogu postojati i različiti rokovi koji utiču na mogućnost preduzimanja pojedinih pravnih koraka.

Upravo zato je važno razlikovati dve stvari: činjenicu da dugo nema novih informacija i zaključak da više ništa nije moguće preduzeti. To nije nužno isto.

Šta ovo znači za predmet Allied Capital Trade?

Kada budemo raspolagali novom informacijom koja je dovoljno proverena i relevantna za položaj naših klijenata, o tome ćemo Vas obavestiti.

Istovremeno, smatramo da je važno da Vam ne predstavljamo kao „novost“ informaciju koja nije proverena ili koja ne menja stvarni položaj oštećenih.

Kod ovakvih predmeta ponekad je odgovornije reći da u određenom trenutku nema značajnog novog razvoja koji možemo potvrditi, nego stvarati očekivanja na osnovu nepotpunih informacija.

In cases that continue over a longer period of time, one of the most common questions is what it means when there are no new developments that can be shared with victims for a certain period.

This question is particularly understandable in matters such as Allied Capital Trade, where a significant amount of time has passed since the original investments and loss of funds.

For this reason, this week we would like to explain an important point: the absence of new publicly available information does not necessarily mean that a case has ended or that no further action may be possible.

Why can there be long periods without visible developments?

International investment fraud cases differ from simpler cases in which the participants, accounts and movement of funds are known from the outset.

Funds may pass through several countries, companies, bank accounts, payment service providers or cryptocurrency wallets. Information required to establish these movements may be held by different institutions in different jurisdictions.

As a result, certain steps may take considerably longer than is apparent from the outside.

Not all information is immediately available to victims

It is also important to understand that information potentially obtained by competent authorities during their work is not automatically made public.

Certain information may remain confidential while verification, an investigation or communication between competent authorities is ongoing.

There may therefore be a difference between what can currently be communicated to victims and what may be taking place or being examined within a particular proceeding.

The passage of time is nevertheless relevant

At the same time, it would be incorrect to suggest that the passage of time has no significance.

As more time passes, additional practical and legal difficulties may arise. Documentation may become more difficult to obtain, companies may cease to exist, accounts may be closed and funds may be transferred further.

Depending on the jurisdiction and the type of proceeding, different time limits may also affect the possibility of taking particular legal steps.

It is therefore important to distinguish between two things: the fact that there has been no new information for a considerable period and the conclusion that nothing further can be done. These are not necessarily the same.

What does this mean for the Allied Capital Trade matter?

When we receive new information that is sufficiently verified and relevant to the position of our clients, we will inform you accordingly.

At the same time, we believe it is important not to present information as a “new development” when it has not been verified or does not materially change the position of victims.

In cases of this nature, it may sometimes be more responsible to state that there is currently no significant new development that we can confirm than to create expectations based on incomplete information.
