Kod predmeta poput Allied Capital Trade, kod kojih je od prvobitnih ulaganja prošlo značajno
vreme, razumljivo je pitanje da li protok godina znači da su relevantni dokazi zauvek izgubljeni.
Odgovor nije nužno potvrdan.
Dokaz ne postoji samo kod investitora.
Investitor možda više nema pristup starom nalogu, emailu ili platformi preko koje je ulaganje
izvršeno.
Međutim, određeni podaci mogu postojati i na drugim mestima.
Banke i platne institucije mogu imati evidenciju transakcija. Kompanijski registri mogu sadržati
istorijske podatke. Email komunikacija može postojati kod druge strane. Finansijske institucije i
drugi pružaoci usluga mogu posedovati podatke koji su nastali u vreme kada je transakcija
izvršena.
Kod kripto-transakcija određeni podaci o samom transferu mogu takođe ostati zabeleženi na
blockchainu, iako utvrđivanje kome konkretna adresa pripada predstavlja posebno pitanje.
Zašto onda protok vremena ipak jeste važan?
Zato što se dokumentacija ne čuva neograničeno u svakom sistemu i pod istim uslovima.
Dostupnost podataka može zavisiti od vrste evidencije, institucije koja je poseduje, države u
kojoj se nalazi i pravila o njenom čuvanju.
Zbog toga starost predmeta može otežati dokazivanje, ali nije isto što i zaključak da više nijedan
trag ne postoji.
Mali podatak može povezati veći deo slike
Stari broj računa, naziv primaoca, email adresa, broj telefona, potvrda transfera ili ime osobe sa
kojom je investitor komunicirao pojedinačno možda ne daje odgovor na pitanje gde je novac
završio.
Ali kada se takav podatak uporedi sa informacijama iz drugih izvora, može dobiti znatno veći
značaj.
Zbog toga je kod dugotrajnih predmeta važno ne odbacivati staru dokumentaciju samo zato što
na prvi pogled izgleda nepotpuno.
Šta ovo znači za Allied Capital Trade?
U ovom trenutku nemamo novu proverenu informaciju koja menja prethodno saopšteni status
predmeta.
To, međutim, ne znači da ćemo pretpostaviti da su zbog proteka vremena svi relevantni tragovi
nestali.

In cases such as Allied Capital Trade, where a significant amount of time has passed since the
original investments were made, it is understandable to ask whether the passage of time means
that relevant evidence has been permanently lost.
The answer is not necessarily yes.
Evidence does not exist only in the investor’s possession
An investor may no longer have access to an old account, email address or the platform through
which the investment was made.
However, certain information may still exist elsewhere.
Banks and payment institutions may retain transaction records. Company registers may contain
historical information. Email communications may still exist in the records of the other party.
Financial institutions and other service providers may hold information created at the time the
relevant transactions took place.
In the case of cryptocurrency transactions, certain information concerning the transfer itself may
also remain recorded on the blockchain, although establishing who controls or controlled a
particular wallet address is a separate issue.
Why does the passage of time still matter?
Because records are not retained indefinitely by every system or under the same conditions.
The availability of information may depend on the type of record, the institution holding it, the
jurisdiction in which it is located and the applicable record-retention rules.
For this reason, the age of a case may make evidence more difficult to obtain, but this is not the
same as concluding that no relevant trace remains.
A small piece of information may help connect a much larger picture
An old account number, the name of a recipient, an email address, a telephone number, a transfer
confirmation or the name of a person with whom an investor communicated may not, on its own,
answer the question of where the money ultimately went.
However, when such information is compared with information obtained from other sources, it
may acquire considerably greater significance.
This is why, in long-running cases, it is important not to disregard old documentation simply
because it appears incomplete at first sight.
What does this mean for Allied Capital Trade?
At present, we do not have any new verified information that would change the previously
communicated status of the matter.
This does not, however, mean that we assume that all relevant traces have disappeared simply
because of the passage of time.
