Allied Capital Trade Newsletter No. 158
To nisu iste stvari.
Dear Clients,
In long-running matters, a period without new information can understandably be frustrating. It is natural to ask: if there has been no news for some time, does this mean that nothing further is happening?
Not necessarily.
“No new information” is not the same as “the matter is closed”
In complex and long-running matters, new information does not emerge at regular intervals. Weeks or months may pass without a development that materially changes the position of affected investors or requires any action from them.
It is therefore important to distinguish between a situation in which there is currently no new verified information and one in which a matter has formally concluded. These are not the same thing.
Why do we not report every piece of information that appears?
In older investment matters, information, documents or claims may occasionally emerge that initially appear to be connected with the case.
However, the mere existence of new information does not mean that it is reliable or that it has any actual impact on the position of our clients.
Before presenting information as a development in the matter, its source, reliability and actual connection to the case need to be assessed. We believe it is more responsible to wait for information that can be verified than to create expectations based on something that may later prove inaccurate or irrelevant.
Periods without news are part of long-running matters
In international cases, information may come from different sources and different jurisdictions. Developments are therefore not always linear or visible to clients at every stage.
A period without new information does not, by itself, indicate what the eventual outcome of the matter will be.
At the same time, it is important to remain realistic: the fact that a matter remains ongoing does not mean that the recovery of funds or another favourable outcome is guaranteed. This is precisely why we aim to distinguish clearly between what has been confirmed, what may still require verification and what currently remains without any new development.
What does this mean for Allied Capital Trade?
At present, we do not have any new verified information that would change the previously communicated status of the Allied Capital Trade matter.
This does not mean that the matter is closed, nor should the absence of new information be interpreted as a negative outcome.
We will continue to monitor information that may be relevant to the matter and to the position of our clients. If a new verified development emerges that changes the current status or requires action from our clients, we will inform you accordingly.
There is no need to resend documentation that you have already provided to us.
Thank you for your continued trust.
Kind regards,
Attorney Zoran Miljaković
