Dear Clients,

A significant procedural development has occurred in the BitClub Network case concerning the defendant Jobadiah Sinclair Weeks, specifically in relation to the sentencing phase.

Namely, Mr. Weeks has submitted a filing arguing that the evidentiary record on which sentencing would be based is incomplete and has not been fully resolved. In particular, he emphasizes that key issues regarding the evidence—such as its authenticity and completeness—were not previously adjudicated on the merits and remain open.

Additionally, Mr. Weeks states that the defense did not have access to the plea colloquy transcript from November 2020 until February 2026, shortly before the Court issued its decision. As a result, the defense was not in a position to properly assess whether all procedural requirements for accepting the guilty plea had been satisfied.

In his filing, Mr. Weeks requested that the Court refrain from proceeding to sentencing until the evidentiary record is completed, including full access to the relevant materials, and until the outstanding evidentiary issues are addressed.

The Court has already granted a request to adjourn sentencing, indicating that further proceedings will depend on the resolution of these issues.

This development highlights that even in later stages of the proceedings, questions regarding the completeness and reliability of evidence may arise, potentially affecting both the timeline and the course of the case.

We will keep you duly informed of any further relevant developments.

Kind regards,
Attorney Zoran Miljaković
