BitClub Network Update – Dismissal of Charges Against Matthew Goettsche Officially Confirmed

Dear Clients,

Following our previous update regarding reports that the criminal charges against Matthew Goettsche had been dismissed, we can now confirm that the dismissal has been formally recorded in the proceedings before the U.S. District Court for the District of New Jersey.

The dismissal is now official

On July 27, 2026, the U.S. Department of Justice formally requested, pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure, that the indictment against Matthew Goettsche be dismissed with prejudice.

In its motion, the Government stated that the Department of Justice had reviewed the case and had decided, in the exercise of its prosecutorial discretion, not to devote further resources to the criminal charges pending against Mr. Goettsche.

On July 28, 2026, Judge Claire C. Cecchi granted the Government’s request and ordered that the indictment be dismissed with prejudice as to Matthew Goettsche.

This means that the development discussed in our previous update is no longer based on media reports alone. The dismissal has now been formally confirmed by the Court.

A significant change from the position earlier this year

The decision is particularly notable considering the status of the proceedings only several months ago.

In February 2026, after plea negotiations between Goettsche and the Government had failed, the case appeared to be heading toward trial. The Government informed the Court that negotiations had continued through December 2025 but that a negotiated resolution was no longer possible, and the parties subsequently addressed the scheduling of a trial.

The Government was preparing for a substantial trial involving numerous witnesses, expert testimony and a significant volume of electronic evidence.

The subsequent decision to abandon the prosecution therefore represents a major change in the course of the case. The brief motion filed in July does not provide a detailed explanation for that change beyond stating that the Department of Justice reviewed the case and decided not to devote further resources to the pending charges.

What does this mean for BitClub Network victims?

This is now the most important issue.

The dismissal formally ends the federal criminal prosecution of Matthew Goettsche under this indictment. However, the documents confirming the dismissal do not explain what will happen to assets previously connected to the case or how the development will affect the possibility of compensation for BitClub Network victims.

It is therefore important to distinguish between the termination of the criminal prosecution against Goettsche and the separate question of recovery of funds for victims.

At this stage, there is no sufficient basis to conclude from the dismissal order alone that recovery efforts have ended. Equally, it would be premature to make assumptions regarding the amount of assets that may ultimately be available or the procedure through which victims could receive compensation.

What about the other defendants?

The dismissal relates specifically to Matthew Goettsche. Other defendants in the BitClub Network case previously entered guilty pleas, and the dismissal of Goettsche’s indictment does not, by itself, invalidate those pleas or terminate the proceedings concerning those defendants.

Their respective proceedings therefore remain relevant, particularly when considering the broader question of restitution and recovery for victims.

What happens next?

Our focus will now be on developments concerning restitution, asset recovery and the remaining BitClub Network proceedings.

We will continue to monitor the official court docket and other reliable sources for information concerning assets connected to the case, the status of the remaining defendants and any mechanism through which funds may become available to victims.

The dismissal of the charges against Matthew Goettsche is a significant development, but it does not by itself answer the question that matters most to investors: what happens to the victims and the recovery of their funds?

As soon as further official information becomes available that may affect the position of BitClub Network victims, we will inform you accordingly.
