Bitclub Newsletter No. 204
Dear Clients,
At present, there is no new verified Court decision concerning Christopher Scanlon’s request that would change the previously reported status or require any action from BitClub Network victims.
However, the property issue raised by his request leads to another important question:
If the Court releases certain restrained property, does this mean that those assets will be returned to BitClub Network victims?
Not automatically.
Releasing restrained property and returning funds to victims are not the same thing
When property has been seized or otherwise restrained during criminal proceedings, a subsequent decision lifting that restraint primarily addresses whether the Government continues to have a legal basis to maintain control over that particular property.
That does not, by itself, mean that the property will be distributed to victims.
The questions of who is legally entitled to particular property, to whom it should be returned, and whether it may ultimately be used to compensate victims may require additional Court decisions and separate legal mechanisms.
Why does this matter in the BitClub Network case?
Earlier Court filings in this case identified significant assets, including funds held in bank accounts and digital assets, as property subject to forfeiture proceedings.
For this reason, any eventual decision releasing specific restrained property would need to be assessed carefully. Such a decision would not automatically mean that all property issues connected with BitClub Network have been resolved, nor would it necessarily mean that those assets have become available for distribution to victims.
What is important for our clients at this stage?
At present, there is no new decision requiring any action from BitClub Network victims.
We will continue to monitor the proceedings, including Scanlon’s request and any further Court action concerning the relevant property. If a decision is issued that may have a concrete impact on the position of victims or the possibility of recovering funds, we will explain its significance and any potential next steps.
At this time, you do not need to take any additional action or resend documentation that you have already provided to us.
Thank you for your continued trust.
Kind regards,
Attorney Zoran Miljaković
