Dear Clients,

The latest update, as you already know, is that the sentencing for the defendants in the Bitclub case has been postponed until September 2024.

This announcement does not mean that in the meantime until September, the judiciary does not take measures and actions to conclude this case. You are aware that upon the arrest of this group, computers, phones, and all found assets were seized from them. These are thousands of pieces of evidence and data that need to be processed, classified, and used for the prosecution of this group and proving their guilt.

Why is proper evidence gathering and evaluation so important?

An indictment contains only charges and is not evidence of guilt. The defendants are presumed innocent and are entitled to a fair trial at which the government has the burden of proving guilt beyond a reasonable doubt. In other words, defendants are innocent until proven guilty in the court of law.

The defendants who confessed or entered into plea agreements are eligible for lighter sentencing, expediting the legal process. However, the main suspect, Mr. Goetsche, hasn’t taken this route, so the case is ongoing.

To secure compensation for the victims, the prosecutor must prove guilt, and the court must thereafter sentence the defendants. All victims feel deceived, with both the lawyer and prosecutor agreeing on the indisputable nature of the guilt. Now, we await the conclusion of proceedings and the court’s decision.
