One of the most common questions we receive from injured parties is whether the fact that they personally made the payment or authorized the transaction means that there is no longer any possibility of legal protection.

It is understandable why this question causes concern, as many people, after realizing they have been defrauded, believe that they bear full responsibility simply because they personally entered their data, confirmed the payment, or approved the transaction.

However, in practice, things are not always that simple.

In cases of this nature, it is important to look at the entire context in which the transaction took place, and not only at the fact that it was formally authorized by the injured party.

In many cases, transactions are the result of previously established trust, false representations, psychological pressure, manipulation, or deception, which means that formal authorization does not automatically mean that there was a genuine and fully informed intention to dispose of funds in the way it was presented.

This is especially important in situations where communication was conducted through individuals falsely presenting themselves as investment advisors, brokers, or other supposed professionals, as well as in cases where remote access tools were used or where the injured party acted based on precise instructions given by third parties.

All of these circumstances may be highly relevant for the legal assessment of the specific case.

For this reason, it is important not to assume in advance that legal protection is impossible simply because you formally carried out a certain action.

Each case requires an individual analysis of all the circumstances under which the funds were transferred or paid.

That is why it is important to preserve all documentation, communications, and any information that may help reconstruct how the transactions took place.

The way in which a decision was made is often just as important as the transaction itself.
