As previously reported, the criminal complaint concerning the Jubilee Group matter remains in preparation for submission to the competent authorities in Sweden.
Because Jubilee Group is an international matter, one practical question is particularly important before a criminal complaint is submitted:
Why does it matter which country receives the complaint?
International investment cases may involve more than one jurisdiction
Online investment schemes can involve victims in one country, companies or individuals associated with another, bank accounts or payment providers elsewhere, and online infrastructure that crosses several jurisdictions.
The fact that a matter has an international dimension does not mean that every authority has the same role or that the same complaint can simply be submitted everywhere in identical form.
Before approaching a particular jurisdiction, it is important to identify the facts and available evidence that may connect the reported conduct with that country and explain why its authorities may be competent to examine the matter.
Why is this relevant to the preparation of the Swedish complaint?
The purpose of preparing the Jubilee Group complaint for Sweden is not simply to repeat information that has already been collected.
The relevant facts, supporting documentation and available information need to be organised in a way that allows the competent authorities to understand the reported conduct, the persons and entities involved, the losses suffered by victims and the elements that may be relevant to their jurisdiction.
In an international matter, presenting those connections clearly can be particularly important because information relating to the same activity may be spread across different countries and sources.
Does submission in Sweden determine what will happen next?
No.
Once the complaint is submitted, it will be for the competent Swedish authorities to assess the information provided and determine whether further steps are appropriate.
Submission itself does not guarantee that an investigation will be opened, that particular individuals will be investigated or that funds will ultimately be recovered.
However, a properly documented complaint provides the authorities with the information and supporting material on which that assessment can be made.
Where does the Jubilee Group matter stand now?
At present, the criminal complaint has not yet been formally submitted in Sweden and remains in preparation.
There is therefore no new procedural decision to report this week and no additional action is currently required from our clients. There is also no need to resend documentation that has already been provided.
Our next significant update will be when the complaint is formally submitted or if another verified development occurs before submission that is relevant to the position of Jubilee Group victims.
