ProCap Newsletter No. 60
Dear Clients,
This week, we would like to address an issue that often creates additional uncertainty for many injured parties during the course of proceedings, particularly in situations where certain users received specific payments during their interaction with the platform.
Based on previous experience, it is common for injured parties to explain that during the initial stages of using a platform they successfully received one or more smaller payments, which created the impression that the investment activity was legitimate.
For a number of individuals, such payments became one of the reasons why trust in the platform was further strengthened and why additional, often larger, deposits were later made.
At first glance, it may appear logical to assume that a successful payment confirms the existence of genuine investment activity and the legitimacy of the platform’s operations.
However, based on previous experience, individual or smaller payments alone do not necessarily constitute proof that actual investment activity existed or that genuine profits were generated.
In certain cases, smaller payments may serve a different purpose — creating an additional sense of security and maintaining the user’s confidence throughout the continuation of the communication process.
It is particularly important to understand that problems often begin to arise only when injured parties attempt to withdraw larger amounts of funds or refuse to make additional payments requested by the platform.
For this reason, information relating to previous payments may also be important for understanding the operating methods of a particular platform and the overall course of communication.
We therefore advise you to preserve all information relating to any payments received, including dates, amounts, transaction confirmations, and any other available documentation that may be relevant to the further course of proceedings.
You will be timely informed of any further developments and updates regarding the proceedings.
Kind regards,
Attorney Zoran Miljakovi
